Lawsuit over GM’s Faulty Eight Speed Transmission
General Motors (GM) is facing a new class action lawsuit because of its eight speed automatic transmission. When selecting a gear using the transmission, it violently shakes, jerks, or goes into a “hard shift.” Thirteen technical service bulletins have been filed about it, but none have fixed the issue. The problem for the 8L90 and the 8L45 transmissions occurs in the rear wheel drive architecture, making GM’s sports cars, luxury sedans, trucks, and SUVs problematic to own and drive. The problem occurs most commonly during accelerating and decelerating the cars in question, but has also been found in cars driving in a single gear. When driving, people reported a hesitation followed by a shudder or jerk when changing gears. Some people even reported that the jerking was so violent that it felt like another car had hit them. One person almost went through their garage door changing from reverse to drive because the reaction was so violent.
The source of the issue is the torque converter of the transmission being exposed to friction. This potentially creates metal shavings that move throughout the transmission preventing the gears from functioning properly, but this is not a definite conclusion. Plaintiffs are seeking statewide classes in at least six states: California, Florida, Illinois, New York, Oklahoma, and Texas. They need repairs and replacement parts for the transmissions. The lawsuit also claims that GM knew about the transmission’s problems shortly after it was released. Plaintiffs claim that GM should have warned consumers about the issues and covered the repairs under each vehicle’s three year and 36,000 bumper to bumper warranties.
