Questions to Ask About Your Asbestos Lawsuit

Despite decades knowing asbestos exposure dangers, asbestos companies and manufacturers withheld, downplayed, and ignored the issue. Not until a series of lawsuits in the early 1970s were companies forced to admit their awareness and responsibility. Those first mesothelioma lawsuits paved the way for modern asbestos litigation. It’s a journey toward compensating those injured by asbestos that the attorneys at Goldberg, Persky & White have been a part of since the beginning.

Five Questions to Ask Your Attorney During Your Lawsuit

The company I worked for filed bankruptcy. Where else can I receive compensation?

Many asbestos companies sought bankruptcy protection when victims began filing lawsuits. In exchange for bankruptcy protection for the company, the government required these companies to set up asbestos bankruptcy trust funds to compensate present and future victims of asbestos exposure.

You might also be eligible for workers compensation benefits. Each states’ laws vary. If you are a veteran, you might also qualify for benefits through the Department of Veterans Affairs.

Where will we be filing the lawsuit?

Some states have more favorable laws regarding asbestos compensation than others. You may be eligible to file your case in multiple states depending on the circumstances of your illness and case.

Will we be taking my case to trial, or can it be settled out of court?

Every case is different. Depending on the parties involved and the details of your case, the parties may reach a settlement agreement before or during the trial. In other cases, the case may have to go to trial to obtain the compensation you deserve.

How long before I receive a settlement?

There isn’t a way to predict a settlement’s timeframe or whether a settlement can be reached for your asbestos lawsuit. Most mesothelioma lawsuits reach out-of-court settlements that award compensation in under a year. If a case goes to trial, it can add several weeks, months, or even years to the lawsuit process.

What type of settlement will I receive?

All cases are not the same. They have different facts and evidence and can result in different outcomes. There isn’t any guarantee that a settlement can be obtained. However, at Goldberg, Persky & White, we use our best efforts to get the greatest settlement possible for you.
