Asbestos Trust Money is Already Waiting

Asbestos Trust Money is Already Waiting

For decades, the carcinogenic qualities of asbestos have affected hard working individuals who worked in industrial, chemical, electrical, and other trade settings. Airborne asbestos fibers are easily inhaled and can lead to many asbestos-related illnesses such as lung cancer, asbestosis, and mesothelioma.  The long latency period between asbestos exposure and illness not only results in difficult treatments, but also means you or a loved one may be entitled to compensation years after initial exposure.

Bankruptcy Trust
Once the dangers of asbestos became known companies were forced to admit their awareness and responsibility. This resulted in many filing for Chapter 11 bankruptcy protection because companies were unable to pay judgments obtained by plaintiffs against them. To ensure that current and future compensation from legitimate asbestos claims could be met, these companies were required to set up trust funds. Many of these asbestos bankruptcy trusts are still being used today and as many as 100 asbestos companies have filed for protection from creditors under Chapter 11 of the bankruptcy code.

Many factors go into filing a claim, and those who believe they were exposed to asbestos have to be able to prove what product they were exposed to or where the exposure took place to have a valid claim. Many are not aware they were even exposed and that is where the experienced attorneys at Goldberg, Persky & White step in. Using a collection of evidence and documentation that has accumulated over the thirty years of asbestos litigation, GPW is able to effectively prepare and prosecute your case.

When to contact an attorney
If you or someone you love has been diagnosed with a disease that is related to asbestos exposure, it is important to contact an attorney as soon as possible because each state has a statute of limitations. This statute of limitations is a time limit on when a lawsuit can be filed.  You will not be able to file a lawsuit if you contact an attorney outside that allotted time. The statute of limitations vary from state- to- state and the more time that passes the less time we have to investigate the situation and file a lawsuit.

The attorneys at GPW have also represented wives and children who were indirectly exposed to asbestos through their husband’s or father’s work clothes. Indirect exposure to asbestos does not preclude a person from filing a lawsuit if they are suffering from an asbestos-related disease such as mesothelioma.
